One Step Ahead
Back Taxes, Unfiled and Late Filing Resolution
Falling behind on tax filings rarely happens the way people assume. In most of the situations we see, nothing was hidden and nothing was intentional. A business grew faster than its bookkeeping. A liquidity event produced a balance no one had planned for. An extension was filed and then the return was never completed. A prior preparer stopped responding. One missed year became three.
What changes the situation is not the original miss. It is the fact that unaddressed delinquency compounds along several tracks at once — penalties, interest, collection authority, and, eventually, the loss of choices that were available earlier.
Back tax resolution is the process of bringing unfiled returns current, establishing the correct amount actually owed, addressing penalties where grounds exist, and resolving the balance through a payment arrangement the IRS will accept. It is handled most effectively before the IRS files returns on your behalf or begins enforced collection, because both narrow the options available.
360 Tax Resolution Strategy
The Four Situations We Resolve
Most back-tax files fall into one of four patterns. Each is handled differently.
Notices, liens, and levies.
Who This Service Is For?
Filing back tax returns is often necessary for individuals whose financial lives involve:
Multiple income sources across several years
Pass-through entity ownership generating K-1 income
Business ownership with layered reporting requirements
Investment activity producing complex reporting obligations
Relocations involving multiple states
Periods of financial transition or business restructuring
For many high-income taxpayers, delays in filing may occur due to mismanagement or underpayment of taxes, missing documentation, or uncertainty about reporting requirements.
When returns remain unfiled, the consequences can escalate gradually.
Potential exposures may include:
Hefty fines and penalties for failure to file
Accumulating interest on unpaid tax balances
IRS substitute returns that overstate taxable income
Complications when applying for loans, refinancing, or selling a business
Increased likelihood of IRS or state correspondence
Addressing these issues early allows taxpayers to regain control of the situation before additional enforcement measures occur.
When the filing is behind, the first task is establishing where you actually stand
Falling behind rarely happens the way people assume. A business grows faster than its bookkeeping. A liquidity event produces a balance no one planned for. An extension is filed and the return is never completed. A prior preparer stops responding. One missed year becomes three.
What changes the situation is not the original miss. It is that unaddressed delinquency compounds along several tracks at once — penalties, interest, collection authority, and eventually the loss of options that were available earlier. Lakeline Tax begins these engagements with IRS transcripts rather than tax preparation, because scope should be determined from the record rather than assumed.
three steps to success
We Will Help You Every Step Of The Way
Handled with the same discretion as every other engagement at the firm, and by an Enrolled Agent authorized to represent taxpayers before the IRS.
A file can contain all three across different years. Sequencing the work correctly is most of the job.
01
Unfiled returns.
No return was submitted for one or more years. There is no statute of limitations on assessment for a year in which no return was filed — under IRC §6501(c)(3), the assessment period never begins to run. That year stays open indefinitely.
02
An assessed balance.
Returns were filed, but tax remains unpaid. Here the collection statute does run: the IRS generally has ten years from assessment to collect, under IRC §6502.
03
Enforced collection.
The balance has moved into active collection — a Notice of Federal Tax Lien, a levy, wage garnishment, or certification of the debt to the State Department.
Our Step-by-Step Process for Filing Back Tax Returns
A Logical Framework for Resolving Prior-Year Tax Issues
Addressing unfiled returns involves more than completing forms. It requires reconstructing financial activity and ensuring accurate reporting across years.
Step 1: Review of Filing History
We begin by identifying which years remain unfiled and whether tax authorities have already prepared substitute returns.
This step clarifies the scope of the issue and helps determine the most appropriate sequence for filing.
Step 2: Reconstruction of Financial Records
Many clients require assistance gathering documentation from prior years.
This may include:
W-2 wage records
1099 income statements
Partnership and S-Corporation K-1 forms
Brokerage and investment reports
Real estate income and expense records
When documentation is incomplete, transcripts from the IRS may provide additional information.
Step 3: Coordinated Preparation of Prior-Year Returns
Each return is prepared with attention to:
Federal filing requirements
Applicable state filings
Entity-related reporting obligations
Proper classification of income and deductions
This coordinated approach ensures that filings across multiple years remain internally consistent.
Step 4: Evaluation of Penalties and Interest
Failure-to-file penalties and interest often accumulate over time.
We help clients understand how these amounts are calculated and whether certain circumstances may warrant penalty relief or administrative consideration.
Step 5: Integration With Current-Year Planning
Resolving back tax filings should not occur in isolation.
Once prior returns are completed, we help clients align their current-year strategy with proactive year-round tax planning, reducing the likelihood of future compliance gaps.

DIY platforms (e.g. TurboTax) lack ability to file multiple years and don’t negotiate with the IRS

we will assist you in any issue and conflict
The failure-to-file penalty runs at ten times the failure-to-pay penalty. Filing a return you cannot yet pay is materially better than filing nothing.
And refunds expire. Under IRC §6511, a refund claim generally must be filed within three years of the return’s due date. Late filers who were owed money — which happens more often than expected where withholding on equity compensation was substantial — forfeit it permanently once that window closes.
Client Experience Example
Case Study: Business Owner With Multiple Years of Unfiled Returns
A business owner relocating to the Austin area had several years of unfiled returns due to changes in business structure and incomplete financial records.
Key challenges included:
Multiple sources of income, including business and investment activity
Incomplete documentation across prior years
Concerns about IRS notices and penalties
Our team assisted with:
Reconstruction of financial records using available documentation and transcripts
Preparation of prior-year federal and state returns
Coordination with the client’s financial advisor to ensure consistent reporting
The result was a structured filing plan that restored compliance and provided clarity for future tax planning decisions.
Case Study: Investor With Complex Income Reporting
An investor managing several partnerships had delayed filings after receiving multiple amended K-1 statements across several years.
The situation required:
Reconstructing partnership income allocations
Coordinating filings across multiple tax years
Ensuring consistency in capital gain and investment reporting
By establishing a systematic approach, the client regained confidence that all filings reflected accurate financial reporting aligned with long-term planning considerations.
Common Pitfalls When Filing Back Taxes
The Dangers of Going It Alone
Individuals attempting to resolve unfiled tax returns without professional guidance often encounter avoidable complications.
Filing Returns Out of Sequence
Submitting returns in the wrong order can create inconsistencies across tax years and trigger additional correspondence.
Incomplete Documentation
Missing income statements or overlooked investment reports may cause returns to appear inaccurate.
Ignoring State Filing Requirements
Taxpayers with multi-state income often overlook required state returns when resolving prior federal filings.
Accepting IRS Substitute Returns Without Review
Substitute returns prepared by tax authorities typically exclude deductions and credits, which may significantly overstate tax liability.
A Structured Path Forward
Unfiled tax returns can create uncertainty, particularly for individuals and business owners with multi-layered financial structures, investments, or pass-through entities.
Addressing these filings through a structured process helps ensure that past obligations are resolved while protecting the integrity of future tax planning.
Lakeline Tax works with clients in Austin, Cedar Park, and across the United States whose financial lives involve complex reporting obligations and long-term tax exposure.

I worked with Lakshmi for our taxes this year and she was outstanding! We had a more complicated tax situation this year-compared to our prior years filings. Additionally, we had a very short window to file our taxes. Lakshmi helped make the process simple and worked hard to help us meet that deadline. They provided excellent customer service with excellent communication through the TD platform-keeping us informed each step of the process. We were able to call her directly (no phone tree!) and if she was Unable to answer, our Calls were returned quickly! I would highly recommend Lakeline Tax and Lakshmi for Your tax needs. I know we will be returning next year!Posted on Yelp![]()

Lakshmi is great, she is always a pleasure to work with. We've been using her tax services for a few years, and see no need to change providers. Given that she does taxes for both my wife and I (day time job + two businesses) it's very convenient to have a professional like her handle everything. She is very clear on what she needs in order to file taxes for you, and is always available for any questions. Yes, it won't be as cheap as TurboTax but you definitely get what you pay for.Posted on Yelp![]()

I knew very little going into this year's tax season, but after speaking with Lakshmi I felt like I was able to understand my situation much better and the things I need to do moving forward with my taxes! I have a small business run out of my home, and with my full-time w-2 job and being in a new state, I had no idea what I could even save on. I got more money back on my returns this year, and Lakshmi made sure of that! Well worth the investment, not just to save the hassle of doing my own returns! I was able to get my questions answered thoroughly and always within a reasonable time frame. If you are in the Leander area and are looking for your taxes to be handled professionally, then I would have to highly recommend Lakeline Tax for the next tax season, or even for your personal or business tax planning needs.Posted on Yelp![]()

Lakshmi and her team are great - they found ways to reduce my taxes that I would have never found on my own, and even found an error on last year's return (completed by another company) that resulted in an amendment that earned me over $1000! Plus, it's just nice to chat with Lakshmi. I definitely feel like she took an interest in me above and beyond my finances, and she was so thoughtful and thorough with her approach that I felt very well cared for. I highly recommend Lakeline Tax!Posted on Yelp![]()

My taxes are no walk in the park. Between digging through digging through past documents and researching nuances to my taxes, lakeline was able to get everything done and handle the brutal process. That means, experience with ESPPs, ISOs, having a portal to make document transfers secure and easy. They were able to find some previous mistakes in my returns which was like finding a needle in a hay stack. I was hesitant at first because it's all online, but now I would Highly recommend.Posted on Yelp![]()
